Validity of Conditions of Sale
1.1. Conditions of Sale apply to purchases of goods and services between the buyer making purchases from restatrade.ee e-store and the seller Restatrade OÜ (hereinafter referred to as Restatrade).
1.2. In addition to the current conditions, legal relations that apply when purchasing from Restarade e-store are also regulated by the valid law of obligations act (hereinafter referred to as VÕS), consumer protection law (hereinafter referred to as TKS) and other legal acts of the Republic of Estonia.
1.3. Restatrade reserves the right to make any changes in its conditions of sale. All the changes are presented on our website restatrade.ee.
1.4. Unintentional mistakes might occur in the descriptions presented in the e-store.
1.5. Restatrade has the right to withdraw from the contract of sale created via the e-store without any sanctions and not deliver the order or offer the service in case of the following:
– the e-store is out of stock;
– the price or qualities of the products have been mispresented due to a system error;
– the buyer does not correspond to the conditions established by restatrade.ee. In case Restatrade is unable to complete the order, Restatrade contacts the buyer and returns the payment if the buyer has already paid.
Prices
2.1. A sales tax of 20% is added to all prices presented in restatrade.ee e-store.
2.2. A courier service fee is added to orders under €100.
2.3. Free transport applies to orders over €100.
Placing an Order
3.1. Add the desired products to the shopping cart.
3.2. To see your shopping cart, select “Cart” in the right-hand upper corner on the website.
3.3. High volume quantities and products that need to be packaged onto a stage are delivered using a delivery service company. The price is €49.90 across Estonia.
3.4. After entering your data, select a suitable payment method.
To order, you need to add the desired products to the shopping cart. To place the order, you need to fill out the required fields. After that you can see the total sum which can securely paid using the following payment methods:
– Estonian bank links: Swedbank, SEB, Luminor, LHV, Coop Pank, Pocopay
– Card payments: Visa/Mastercard
NB! When using a bank link payment method, make sure to click on the ‘Return to merchant’ button. Payments are processed by Maksekeskus AS. Payments are done outside the e-store in a secure environment: in a secure environment of the corresponding bank when using a bank link or in a secure environment of Maksekeskus AS when paying by credit card. The seller has no access to the buyer’s bank or credit card information. The contract enters into force when the amount payable is transferred to the bank account of the online store.
The owner of the e-store is the responsible processor of personal data and forwards personal data necessary for making payments to the authorized processor, Maksekeskus AS. If the ordered goods cannot be delivered due to stock running out or for any other reason, the buyer will be informed as soon as possible and the money paid (including the shipping cost) will be refunded promptly, but no later than within 14 days of receiving the notification.
3.6. To confirm your order, tick the “Yes, I agree to the terms” option and then select “Next”.
3.7. Orders placed in restatrade.ee e-store are handled on business days from Mo to Fri from 9:00 to 17:00. If the order is placed on Friday after 15:00, the order is processed on the following Monday.
Contract of Sale entering into Force
4.1. According to the contract of sale of goods, Restatrade is obligated to deliver the existing, produced or to be owned in the future goods to the buyer and enable the delivery to the buyer. The buyer is obligated to pay to Restatrade the amount presented on the invoice and accept the goods. 4.2. The contract of sale enters into force after the payment made by the buyer is transferred to the bank account of Restatrade.
Delivery
5.1. After the contract of sale has come into force, the courier delivers the order to the address given on the order. 5.2. The time of delivery is five business days. 5.3. We deliver within Estonia. 5.4. To have deliveries without delays, you need to be careful and enter accurate and valid data concerning the delivery information when placing an order.
Right of Withdrawal
6.1. After receiving the order, the buyer has the right to withdraw from the contract entered into with the e-store within 14 days. The right of withdrawal only applies to private individuals but does not apply to legal persons.
6.2. To exercise the 14-day right of withdrawal, you must not use the ordered goods in any way other than is necessary to ensure the nature, characteristics, and functioning of the goods in the same way you would be allowed to test the goods in an actual store. E.g., you cannot make coffee with a coffee machine, do laundry with a washing machine, etc.
6.3. The product that is returned has to be complete (including the package and all items included in the package). If it was a campaign product that was accompanied by a gift or any other products, the whole set must be returned (i.e., all items).
6.4. In case the goods have been used for any other purposes than is necessary to ensure the nature, characteristics, and functioning of the goods or there are signs of use or wear, Restatrade has the right to decrease the amount refunded according to the decrease in value of the goods.
6.5. To return the goods, you must submit a declaration of withdrawal (in free form) and send it to info@restatrade.ee within 14 days of receiving the goods.
6.6. The buyer shall bear the cost of returning the goods, except in cases where the reason for the return lies in the fact that a refundable product does not comply with the order (e.g., a wrong product).
6.7. Refunds are made within 14 days (including the initial delivery costs). 6.8. Restatrade is not responsible for defects that occurred after the goods were handed over to the buyer.
Force Majeure
7.1. Restatrade is not responsible for damages caused to the buyer or the delay in delivery in case the damages or delay in delivery is due to circumstances that Restatrade could not affect or foresee.
Data Processing
8.1. By entering their data in the e-store and confirming accordingly, the buyer agrees to their personal data (name, phone number, order delivery and/or home address, e-mail) being processed and forwarded to delivery partners to deliver the orders.
8.2. Restatrade has the right to use the buyer’s contact data to send advertisements and other information to the buyer.
8.3. The buyer has the right to refuse from their data being collected and processed, unless it is needed to answer a claim based on the contract or deliver the order.
8.4. Restarade is the responsible processor of personal data and forwards personal data necessary for making payments to the authorized processor, Maksekeskus AS.
Submitting Claims
9.1. According to the law of obligations act, if the product does not comply with the conditions of the contract, the client has the right to submit claims for two years from the delivery of the goods. During the first six months, it is assumed that the defect was present at the moment of buying, and the nature of the defect must be investigated by the seller.
9.2. In case of a defect, the client is obligated to notify Restatrade via email at info@restatrade.ee and present the following information: name, contact data, and the defect of the goods. The corresponding declaration must be submitted no later than 2 months after discovering the defect.
Restatrade.ee is not responsible for:
– Damages to the goods resulting from the customer’s fault or negligence.
– Defects resulting from misuse of the goods.
– Natural wear and tear of the goods after conventional usage.
9.3. The repairment or replacement of defected goods will be agreed between Restatrade and the buyer.
9.4. All claims will be examined, and the buyer will be contacted as soon as possible, but not later than in five business days after receiving the claim.
9.5. The buyer has the right to request a discount or refund from Restatrade, if Restatrade is not able to repair or replace the goods or the repairing or replacing fails.
The Buyer’s Right to Turn to the Consumer Disputes Committee
10.1. If Restatrade has refused to settle a buyer’s complaint or the buyer does not accept the solution offered by Restatrade and feels that their rights have been violated or interests have been damaged, the buyer has the right to submit a complaint to the Consumer Disputes Committee via the Consumer Protection Authority. The buyer can submit their complaint by themselves or via a representative. The information of the Consumer Disputes Committee is available on the website of the Consumer Protection Authority. To solve problems occurring in the European Union membership countries, you should turn to the European Consumer Centre.
